I Curse That Goddamn Bankruptcy Law

Another piece of the awesome Bush Legacy:

There’s no shortage of blame for the mortgage crisis that drove the economy into the ditch.

But here’s a fresh culprit: the 2005 bankruptcy reform act, which was strongly pushed by the credit card industry.

So say three researchers at the Federal Reserve Bank of New York, who argue that the legislation shifted risk from credit card lenders to mortgage lenders, helping trigger the surge in home foreclosures.

Thank you, Bush Republicans.

And by “thank,” I mean something else. Begins with an F.

(And yes, I realize that Vice President-elect Biden voted for the law. A fact I’m trying hard to reconcile.)

He told me two years ago that since 1996, he had never, not even once, had a mortgage application denied. There had been some times when he had to shift a client to an ARM or subprime, but for the most part, nearly every client got into a prime mortgage.He told me that two years ago. I nearly choked out, “How is that possible? You’re telling me you’ve never had one bankruptcy client turned down?”His answer? “Those are some of the easiest people to get done.” And he laughed all the way to the bank.Sure, you could blame him, a mortgage broker, but why? He’s just giving people what they want, and giving the banks and mortgage companies what they so desperately wanted.Not one turn down for a home in 10 years, in the city of Milwaukee.And we’re still looking for culprits in the mortgage meltdown? The CC companies have their own demons, but they didn’t cause the mortgage bubble.     Alan,Yes, I did. I go back to, “I’ll definitely pay that credit card bill and short myself on my mortgage.”Alan, people skip their credit card payments all of the time. Just because they can’t file for “easy” bankruptcy does not mean they don’t let their CC drift into delinquency and then closed. Of course, they still have the debt hanging over them, but that doesn’t mean they are going to pay it before they pay their mortgage.The whole point is, CC’s are not responsible for asinine lending practices that created the housing and mortgage bubble.

It’s a helleva lot harder (a chapter 13, when you want to keep your home is) You have to pay not only the current month’s mortgage but a part of whatever was in arrears. Now, a chapter 7 lets you walk away from your debts (or it did) but that means losing the house, too, so many people don’t opt for that.And you’re one of the lucky ones who had 15 steady years of work. Some of us scrimped & saved & worked hard & ended up having the primary wage-earner’s job shipped overseas & losing our houses anyway. So congratulations to you! As to your attitude about people who were not as fortunate as you….fuck you.(BTW, I had NO credit card debt when it happened to me, since I get rid of all my credit cards more than 10 years prior.)
