Food and Safety Modernization Act of 2009

A bill known as HR 875, the Food and Safety Modernization Act of 2009, is racing through Congress and it’s intended to amp up safety inspections and fines on imported food and farm-grown products sold in stores — at least, food products that fall under the jurisdiction of the FDA. It’s essentially a response to the tainted peanut fiasco earlier this year.

But there are a lot of rumors floating around claiming that the bill would ban organic food, fine small farmers $1 million, shut down farmer’s markets, and even penalize you for your backyard garden. As near as I can tell, none of this is actually in the bill. Mainly, HR 875 appears to deal with the FDA and not the USDA, and it specifically (though perhaps not exclusively) covers food sold in grocery stores. For what it’s worth, the word “organic” doesn’t even appear in the bill.

All of that said, the language of the bill is vague and could potentially be exploited to impose enormous fines on the wrong people. Hopefully the efforts to stop the bill will create enough noise to at least close those loopholes.

Ultimately, though, the government is yet again attacking the wrong country (metaphorically-speaking this time). The CDC says that foodborne diseases kill 5,200 Americans every year. But I wonder how many are killed by cancer and other sicknesses caused by pesticides, chemical preservatives and artificial sweeteners — all of the terrible crap that’s supposed to make our food “safe” and “better.”

    I’m pretty sure the friends and family of people that die from foodborne diseases don’t think there number is statistically small. And for the most part the people killed by foodborne illness are killed relatively quickly… it takes years to die by preservatives and Splenda. I’m not saying that those things shouldn’t be researched and regulated, but there’s no reason to not do both.

    I love the use of the word “organic” when describing certain types of food.Pardon me, sir, but isn’t ALL food organic? Mmmm, yes, yes, I think I read that somewhere, quite certain, really, what, what. After all, it’s not that some foods aren’t organic, it’s whose organs were used to fertilize the food, yes. For example, my organs would be best utilized to fertilize hops, or, barley, while my daughter’s organs would be better at fertilizing pure things, such as strawberries and cotton candy trees.Bob, what food would your organs best fertilize, in our never ending quest for the orgasmic, perfect, organic food? Perhaps the beef plant? Maybe it would be the seldom seen, yet frequently longed for Salmon root? No matter, really. It’s all in the organs, and whatever we fertilize, it’s ALL organic, all of the time, God bless the Queen.Cheeereo!

    PPP: The best part? “Organic,” in its chemical context, would include everything from normal organic food to grocery-store brands to preservatives to plastic and gasoline.As for the bill itself, I’m hoping that the efforts to stop the potentially unpleasant parts of the bill manage to just stop the bad bits. Something tells me there are people who’d like to see the restrictions removed from mass producers, but kept on their competition.
