The notion that judges in America, at any level up to and including the USSC, have not been appointed throughout history with the implicit assumption that white men make better decisions than anyone else is laughable.The suggestion that those same judges did not consider their own life experiences, and were not affected by their own personal biases in rendering judgment (often to the detriment of non-white, non-male, non-American litigants) is demonstrably wrong.The argument that Justice Sotomayor has been nominated only because she’s an Hispanic woman – that there are better qualified jurists available who suffer the disability of being white men – is simply obtuse and ignorant. In fact, there is no “most qualified” in the same way there is no “best drummer.” When choosing between Dave Weckl, Billy Cobham, Louis Belson, and Buddy Rich, anyone who starts hollering about which of them is “best” ought to immediately be removed from the debate for being a shallow, biased, blithering imbecile.Judicial temperament is not the ability to be unbiased, it is the ability to set one’s bias aside in rendering decisions. As between the judge who claims to be unbiased and the one who says, “This is the nature of my bias – I will try my best not to let that affect my decision,” you are better off with the later. To denigrate her record, her nomination and Sotomayor personally as a matter of partisan politics – to say the things the right has scraped up from the bottom of the sewer – reveals far more about them than it does about her…and goes a long way to underlining why the GOP is unlikely to regain any sort of elected power in America save in places where people like Sessions and Tancredo might comfortably run and Glenn Beck is always welcome.It is nothing more than their own racism that spurs them to shout “Racist” – some twisted notion that follows flawed reasoning: Most of the judges in America are white men, thus most of the qualified candidates must be white men. Therefore, if the nominee is NOT a white man, it must be reverse racism.Now, they either rely on this argument because they are stupid enough to believe it, or because they think it will be effective. If the former, well…then they’re just stupid. If the later, however, they are just fucking evil.In either case, it doesn’t seem like anyone should be taking their arguments seriously.
