    Excellent Lee. This bigotry is no different from any other bigotry.Thinking out loud. Why has none of the forcible discharged for homosexuality armed services personnel ever filed suit for denial of equal protection? The DoD is not allowed to violate the constitution is it? Don’t ask, don’t tell as a policy is clearly unconstitutional.

    Git – Sexual orientation isn’t yet a recognized class under the Court’s equal protection analysis. The Supreme Court only applies low level rational basis scrutiny to just about any law that doesn’t classify based on either race or gender (which basically means EXTREME deference to the legislature).The doctrine of Equal Protection had been consistently expanded for a long time….then came the Rhenquist court. They haven’t substantively expanded the doctrine in a very long time, and aren’t likely to do so whilst conservatives still have the 5-4 majority.

    Thank you for those insights rogect8.So the CT Supreme Court interprets equal protection in a broader fashion than the SCOTUS. I believe that the CT Court’s interpretation is the correct one. You would have to generate an incredible tale to counter the rather obvious reading that they gave the law. Adding exceptions that are not specifically written is not a valid way to interpret law IMHO.Everyone is granted equal protection unless they are gay is not what the equal protection clause says. Just because perversions were provided in the past to justify Jim Crow does not make those perversions correct.
