Get Ready to Be Sued

Huffington Post:

Pima County [Arizona] Sheriff Clarence Dupnik … called the law “racist” and “disgusting” and “stupid” and, in his “nuanced judgment” could not be enforced without mandatory racial profiling. Dupnik’s reckoning of the legal issue is that he’s just as likely to be sued for racial profiling as he is for not doing enough racial profiling, so he’s standing pat, and will not enforce the new law.

Sheriff Dupnik should prepare to be sued by a wide variety of wingnuts who, under the new law, can sue police officers for not adequately enforcing the anti-Hispanic law. Perhaps a legal defense fund is in order.

Adding… Can you imagine the black codes and neo-slavery era laws if the police were coerced under threat of lawsuit to enforce the rounding up of African Americans?

    I’ve got to think that the first time this law gets enforced against a citizen with the wherewithal and the means to take this thing to court, it will be ruled flagrantly unconstitutional. Once it makes its way into FEDERAL Court that is….I don’t know much about Arizona’s state court system, but if it’s anything like the rest of that state…

    Say it gets overturned. The odds are long, but who gives a damn?The story here is that the governor’s approval rating shot from sub-40 to 56%+, and 70%+ approve of the law. I think that the law is a bit radical myself, but even if it were more moderate you should consider that the 70% might be 85%.Can someone sue a zeitgeist? Something is happening here… and what it is..is pretty clear.The “doing the work that we won’t do” lie was never more exposed than during this mild depression (it’s not a recession- everyone is unemployed or severely underemployed).

    @emisqueNo! I live here and I don’t support this stupid law. I feel bad for the LEO’s who will get sued no matter what they do. There are some people with sense living here it’s just that an idiocracy has taken over and they have all the money and all the power (i.e., Hayworth, McCain, the Repub Legislature…..)

    Just kidding, I.G. I have relatives in Arizona, and all are decent folks. A lot of people in my family are married to people that were not born in the USA. This bill is extra sucky for us and ours. I really wonder about my conservative cousin and his Colombian born wife. They are gun totin’ right wingers from Nevada, successful pillars of the community, with sons serving in the armed services. Very patriotic. I wonder how she would feel in Arizona when she is asked to produce her ID, and if they wanted more than her driver’s license if they would arrest her.

    What if the majority of illegal immigrants in AZ were as white as Cescaboob (I’m assuming from his picture over at HuffPst that he is white – I know, I know, that’s not a fair assumption. He could be hispanic or mulatto. He’s got that mustache and beard – What are you hiding, Cescaboob) ?There might still be some who questioned AZ’s new law, but nobody would be screaming “BOYCOTT!!!” at the top of their lungs. Maybe Cescaboob would be, but I doubt it. And he wouldn’t be making comparisons between the AZ law and the KKK mentality of 50 or 100 years ago.NO, this thing is all screwed up and Cescaboob is just adding to the histeria.

    @josephS – So basically what you’re saying is that if the law didn’t directly target Hispanics, people wouldn’t be so mad that the law is directly targeting Hispanics. Gosh, I never thought of it that way before. Brilliant.You suggest that if the law targeted white people instead, there wouldn’t be the same level of outrage. I guess my question to you would be…how do you know that? In the entire history of this country, when has there ever been a law specifically targeting white people? (Take all the time you need. I’ll wait). Ethnic groups tend not to make laws that are directed specifically at their own group.But regardless of who the law targets, it’s unconstitutional. 1) Immigration has been ruled time and time again to be the business of the federal government – the states aren’t allowed to come up with their own laws on this. There’s very little room for discussion on that point. 2) Equal Protection Clause. Duh.Also, you spelled “hysteria” wrong you fucking dunce.
