Judge Amit Mehta of the U.S. District Court for the District of Columbia has ruled against Judicial Watch in their lawsuit against the State Department.
Judicial Watch sought to force the State Department to immediately release a cache of emails directly related to Benghazi without properly reviewing them for potentially classified information.
Judge Amit Mehta said that it would be “unwise and potentially risky” to order the government to quickly release some of the 329 emails specifically related to the 2012 terror attack in Benghazi, Libya, which it had recently discovered. [...]
The best solution would be “to keep this on course,” Mehta said, since the government has already “made concrete commitments” in the other case.
As Judge Mehta pointed out, the emails Judicial Watch wants access to are already scheduled for release to the public, however they must be reviewed before they can be released.
Judicial Watch lawyers and president Tom Fitton said the judge's ruling is just another "continued delay" and that the "smoking gun" is still out there somewhere. What exactly a smoking gun would allegedly prove or reveal still isn't clear.
It seems plausible to me that Judicial Watch and other conservatives would blame the State Department and probably even Hillary Clinton herself if the court had ruled in their favor and forced the department to immediately release potentially-classified information.
From a certain perspective, you could say Judicial Watch wanted to force the State Department to make a mistake.
Judicial Watch was founded by infamous birther conspiracy theorist and leader of the failed movement to overthrow the government Larry Klayman.
