Virginia Delegate Bob Marshall (R) apparently thinks he has a tighter grasp of the law than the attorney general of Virginia, the United States Supreme Court, and numerous federal judges across the country.
Marshall wants to impeach Virginia Attorney General Mark Herring for allowing “sodomy marriage.”
Marshall filed the resolutions seeking an inquiry for Herring’s impeachment last week, but in a new email to supporters, he outlined his reasons for doing so. “Removing all standards against same sex or sodomy ‘marriage,’” he explained, is “to the detriment of children and the well-being of society.”
It’s entirely possible that straight marriage could also be “sodomy marriage” so I’m not sure where he’s going with this. Is he suggesting the children of straight couples are also at risk if their straight married parents engage in anal sex? Surely not.
Aren’t bans on same-sex marriage falling apart across the nation anyway? Bob Marshall addressed that and, apparently, he knows better than the federal judges who’ve dismantled same-sex marriage bans.
In the email, Marshall also extended a threat to impeach judges who might overturn bans on same-sex marriage. Rulings based on the 14th Amendment’s equal protection “make no sense,” he argued, because when that Amendment was ratified, “sodomy was a felony in nearly every state.”
When the Fourteenth Amendment was adopted in 1868, homosexuality was still seen as some form of devilry therefore it makes no sense to overturn a ban on same-sex marriage in 2014. Is that right?
Anti-sodomy laws were invalidated by the Supreme Court in 2003 in Lawrence v. Texas.
I don’t see this impeachment campaign going anywhere.
